Terms of Sale

These Terms of Sale govern purchases made through John John Fine Photography, operated by John Stephenson LLC, based in Palm Beach, Florida.
By placing an order through this website, you agree to these Terms of Sale, along with any policies referenced on this website, including Shipping & Delivery, Returns, Cancellations & Damages, Privacy & Cookies, and any product-specific terms listed on the applicable product page.

Purchases
John John Fine Photography sells limited-edition framed fine art photographic prints and related artwork.
By placing an order, you represent that you are at least 18 years old or are placing the order with the consent and supervision of a parent or legal guardian.
An order is not accepted until it has been confirmed. John John Fine Photography reserves the right to accept, decline, cancel, or limit any order for any reason, including pricing errors, inventory errors, edition availability, payment issues, suspected fraud, shipping restrictions, or other fulfillment concerns.
If an order is cancelled after payment has been made, a refund will be issued to the original payment method unless another arrangement is made in writing.
Pricing
Prices are listed in U.S. dollars unless otherwise stated.
Prices may change at any time, for any reason, without notice. Price changes may occur as editions sell through, as materials change, as framing costs change, or at the artist’s discretion.
A price shown on a prior visit, prior listing, social media post, advertisement, invoice draft, or inquiry response does not guarantee future availability at that price.
Payment
Full payment is required at checkout unless otherwise arranged in writing.
Payment methods available at checkout may include major credit cards, debit cards, Apple Pay, Google Pay, Amazon Pay, PayPal, Affirm, Afterpay, Klarna, Cash App, or other payment options supported by the website at the time of purchase.
Wire transfers may be arranged directly with the artist upon request.
Orders paid by wire transfer are not confirmed until funds have cleared.
Sales Tax, Duties, and Import Charges
Sales tax is collected where required by law.
For international orders, the buyer is responsible for customs duties, import taxes, brokerage fees, VAT, GST, and any other destination-country charges unless otherwise agreed in writing before shipment.
Failure to pay customs, duties, or import charges may result in delays, return shipment, storage fees, or forfeiture. Any related costs are the responsibility of the buyer.
Editions
Each limited-edition work is produced according to the edition information listed on the product page.
Edition sizes vary by work and size. Different sizes of the same image may be treated as separate editions.
Edition numbers are assigned as works are sold, while the final edition size is predetermined.
Once an edition sells out, it will not be reprinted in the same size. In the rare event that a confirmed editioned work is destroyed, the artist may, at his sole discretion, produce a replacement for that specific edition number. Any replacement will be documented and will not increase the stated edition size.
Artist Proofs
Artist proofs may be produced at the artist’s discretion and are separate from the numbered public edition. When released, artist proofs will be clearly marked, signed, and documented.
Product Images, Room Views, and Digital Staging
Product images are intended to represent the artwork, framing, scale, mood, and presentation as accurately as reasonably possible.
Room views, lifestyle images, and gallery images may include staged interiors, digitally rendered environments, or AI-generated backgrounds for presentation purposes only. They are provided to help collectors visualize scale and placement.
The photographic artwork itself is not AI-generated, digitally composited, or Photoshopped. It remains true to the film negative, subject only to the scanning of the negative and necessary preparation for fine art printing.
Colors, tones, scale, frame appearance, mat appearance, and materials may appear differently on screens. Final presentation may vary slightly due to lighting, display settings, production tolerances, material availability, and the artist’s final presentation decisions.
Framing and Materials
Framing, matting, paper, glazing, and other finishing details are selected by the artist according to the work and edition.
Frames, mats, glazing, papers, labs, and materials may vary by work and may change at the artist’s discretion. Specific details are listed on the product page when applicable.
Museum glass is generally used unless otherwise stated. Museum-grade acrylic may be available by special request and may involve additional cost or production time.
Shipping
Shipping terms are governed by the Shipping & Delivery policy.
Standard shipping within the United States and Canada is complimentary unless otherwise stated. International shipping is calculated at checkout or arranged directly with the artist.
Signature upon delivery is generally required unless otherwise requested. If a buyer requests delivery without signature, the buyer assumes responsibility for loss or theft after carrier-confirmed delivery.
Returns and Cancellations
Returns, cancellations, and damage claims are governed by the Returns, Cancellations & Damages policy.
Eligible returns must be requested within 3 days of delivery. Approved returns are subject to a 5% return/restocking fee, with a minimum fee of $100. Special orders and custom requests are final sale.
Commissions and Custom Work
Commission, custom sizing, custom framing, hospitality, trade, and special project inquiries may be considered at the artist’s discretion.
Custom work, once confirmed, may be subject to separate terms and may be final sale.
Copyright
Purchase of a print transfers ownership of the physical artwork only.
All copyright, reproduction rights, licensing rights, digital rights, commercial usage rights, and other intellectual property rights remain with the artist unless expressly transferred in a separate written agreement signed by the artist.
Buyers may not reproduce, copy, scan, photograph for commercial use, publish, license, distribute, alter, mint as an NFT, create derivative works from, use in advertising, or otherwise exploit the artwork or image without prior written permission.
Personal display of the physical artwork is permitted.
Website Content
All images, text, designs, graphics, product descriptions, logos, branding, and website content are owned by or licensed to John John Fine Photography and may not be copied, reproduced, distributed, modified, or used without written permission.
Limitation of Liability
To the fullest extent permitted by law, John Stephenson LLC and John John Fine Photography are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from the purchase, use, display, shipping, delay, or inability to use any artwork or website content.
The maximum liability for any claim relating to a purchased work will not exceed the amount paid for that work.
Nothing in these Terms limits any rights that cannot be limited under applicable law.
Force Majeure
John John Fine Photography is not responsible for delays or failures caused by events outside reasonable control, including carrier delays, customs delays, lab delays, framing delays, material shortages, severe weather, natural disasters, strikes, supply chain disruptions, acts of government, illness, war, or other events beyond reasonable control.
Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Any dispute arising from or relating to these Terms, this website, or a purchase from John John Fine Photography will be brought in the state or federal courts located in Palm Beach County, Florida, unless otherwise required by law.
Changes to These Terms
John John Fine Photography may update these Terms at any time. The version posted on this website at the time of purchase will govern that purchase.
